Tamil Nadu reenacted 10 Bills and Supreme Court’s Observation on Governor

This is the third time Governor RV has been involved in a conflict with the DMK government. In February 2002, he returned the anti-NEET bill and in March 2023, the bill on banning online gambling stoked controversy. The apex court has come down severely on the governor’s inaction. 

Tamil Nadu Government’s Rebuttal

Tamil Nadu CM MK Stalin furiously stated that the government’s refusal to assent to the bills passed by the assembly was unconstitutional and undemocratic. His duty is to provide assent to bills passed by the state legislative assembly unanimously with legitimacy and deriving of people’s mandate. 

Further, the CM informed that he has written to both the Prime Minister and President of India regarding the odd behaviour of Governor RN Ravi. But there was no change from him. And that is the reason we approached the Supreme Court of India with grave concern. Meanwhile, in a hasty manner, RN Ravi sent back ten bills to the assembly, which is a mockery of the system. 

Ten Bills Passed Again

Article 200 of the Constitution says the governor is bound to give assent when a Bill returned by the governor for reconsideration is adopted again by the assembly. TN Speaker Appavu said, “We held a special session to reenact the 10 bills. The government wanted the session to be convened.” The most controversial bill that needs to be signed by the President is the Tamil Nadu Admission to Undergraduate Medical Degree Courses Bill 2021. This bill aims to fight the NEET, which is the national admission test for undergraduate and postgraduate medical courses.

Another bill is the Chennai University (Amendment) Bill, 2023 aims to reduce the governor’s role as chancellor of the University and give the state government more power to choose the vice-chancellor of the University of Madras.

Governor is RSS Agent!

Tamil Nadu Water Resources Minister Durai Murugan accused Governor RN Ravi of being an RSS agent and lobbying for the BJP. He is disturbing the peace in the state. Even MDMK general secretary Durai Vaiko has called Governor RN Ravi an ‘RSS agent in Tamil Nadu.’

CM Stalin’s son Udhayanidhi Stalin proclaimed Governor RN Ravi should change his name to ‘RSS Ravi’ Further, he challenged the GovernorGovernor to resign from his post and contest elections in Tamil Nadu, adding that even an ordinary DMK worker would win against him. Tamil Nadu Law Minister S. Regupathy claims that we are not going to withdraw the case from the Supreme Court, even if the governor pleads to us.

Supreme Court Questions TN Governor 

The highest court in the country questioned the rationality behind the delaying of bills to provide assent. Apart from Tamil Nadu, Punjab also approached the Supreme Court to intervene in the constitutional limbo created by the governor.

The bench comprising Chief Justice of India DY Chandrachud, Justice JB Pardiwala and Justice Manoj Misra noted that the governor’s decision to “withhold” the assent on ten bills was a “matter of serious concern.” The DY Chandrachud asked, “What was the Governor doing for three years? Why should the governor wait for the parties to approach the Supreme Court?”

The TN Government submitted an affidavit that if the governor is allowed to withhold bills indefinitely, the governance will be paralysed and added that the Constitution never envisaged such a power to the governor. In addition, the government stated that because of the arbitrariness of the governor, seven crore people are suffering in Tamil Nadu.
